Terms of Use for Primy Apps

Welcome to Primy Apps. These Terms of Use ("Terms") govern your use of our applications and services (the "Apps"), including but not limited to the Primy Form Builder, available through the Shopify App Store. By installing or using any of our Apps, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must uninstall the App and discontinue its use immediately.

1. Use of the App

You may use our Apps only in accordance with these Terms and any applicable Shopify policies. You agree to:

  • Use the App solely for lawful business purposes
  • Provide accurate and current information as needed
  • Comply with all applicable laws, including privacy and data protection regulations
  • Not use the App for any unlawful or abusive purpose, including spamming or data scraping

2. User Responsibilities

As the store owner or authorized user, you are responsible for:

  • All actions performed through your Shopify store
  • The accuracy of any data submitted through our App
  • Securing your account credentials
  • Managing the data of your customers in compliance with applicable regulations (e.g., GDPR, CCPA)

You agree not to use our Apps to store or transmit malicious code, interfere with App operations, or attempt unauthorized access to any system.

3. Customer Data and Permissions

Our Apps may require access to protected customer data (such as name, email, phone, and address) via Shopify's Protected Customer Data scopes. You acknowledge that:

  • Access to such data is requested solely to fulfill app features (e.g., creating customers from form submissions)
  • You are responsible for obtaining appropriate consents from your customers where required
  • We process this data in accordance with our Privacy Policy

4. Intellectual Property

All intellectual property rights in the App and its contents (including code, branding, logos, and documentation) are owned by Primy Apps or its licensors. You may not:

  • Copy, modify, reverse-engineer, or distribute the App or any part thereof
  • Use the App in a way that infringes on our intellectual property or the rights of others

You are granted a limited, non-exclusive, non-transferable license to use the App solely within your own Shopify store.

5. Fees and Billing

Some features of our Apps may require a subscription or one-time payment. By using paid features, you agree to:

  • Pay all applicable fees through your Shopify billing account
  • Allow recurring billing if applicable
  • Notify us of any billing disputes within 30 days of the charge

Failure to pay may result in suspension or termination of access to the App.

6. Termination

We reserve the right to suspend or terminate your access to our Apps if:

  • You violate these Terms or applicable laws
  • You abuse, misuse, or interfere with the App's normal operation
  • Required by Shopify or a legal authority

Upon termination, your license to use the App ends immediately. Data retention will be governed by our Privacy Policy.

7. Disclaimer and Limitation of Liability

The App is provided "as is" without warranties of any kind. We do not guarantee that:

  • The App will be error-free or uninterrupted
  • It will meet your specific business needs
  • Data will be transmitted securely at all times

To the fullest extent permitted by law, Primy Apps disclaims all liability for indirect, incidental, or consequential damages arising from use of the App.

8. Indemnification

You agree to indemnify and hold harmless Primy Apps, its affiliates, and employees from any claims, losses, liabilities, damages, and expenses arising out of:

  • Your use of the App
  • Violation of these Terms
  • Violation of any third-party rights, including data privacy rights

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted within the App or on our website with an updated "Effective Date." Continued use of the App constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Primy Apps is incorporated, without regard to conflict of law principles.
